Terms of Use for the Pixxle Account and Pixxle Me Application

Preamble

These Terms of Use (the “Terms”) are entered into between:

Pixxle, a French simplified joint-stock company (Société par Actions Simplifiée) with a share capital of €5,000, whose registered office is located at 31 Parc du Golf, CS 90519, 13593 Aix-en-Provence Cedex 2, France, registered with the Aix-en-Provence Trade and Companies Register under number 804 801 645 (“Pixxle”),

and any individual using a Pixxle Account or the Pixxle Me application (the “User”).

These Terms define the conditions governing the creation, use, management and deletion of a Pixxle Account, as well as the use of the Pixxle Me application.

Certain Pixxle applications or services may be subject to additional terms, particularly where they provide paid features or subscriptions.

Article 1 – The Pixxle Account and Pixxle Me Application

1.1 The Pixxle Account

The Pixxle Account is the user account that enables the User to identify themselves and access compatible applications and services provided by Pixxle.

The purpose of the Pixxle Account is to provide the User with a single account for accessing the Pixxle ecosystem without having to create separate credentials for each application.

The Pixxle Account may be used to access current and future Pixxle applications compatible with this authentication system.

1.2 The Pixxle Me application

Pixxle Me is the application used, in particular, to create, manage, secure and use the Pixxle Account.

It acts as the central point through which Users can manage their identity within the Pixxle ecosystem and authorise connections to compatible applications and services.

Depending on the available features, Pixxle Me may enable Users to:

  • create and manage a Pixxle Account;
  • manage certain personal information associated with their account;
  • secure access to their account;
  • verify certain information required for account security;
  • manage trusted devices;
  • authorise connections to Pixxle applications or services;
  • authorise connections to compatible third-party services;
  • review or manage certain permissions associated with their Pixxle Account.

Pixxle Me features may evolve over time.

Article 2 – Acceptance of these Terms

Creating or using a Pixxle Account constitutes acceptance of these Terms.

The User acknowledges having read these Terms before creating their account and agrees to comply with them.

Pixxle may amend these Terms to reflect changes to its services, technologies or applicable regulations.

Where a material change may affect Users’ rights or obligations, Pixxle may notify them through an appropriate method, including email, notification or directly within its applications.

The current version of these Terms is available on the Pixxle Me website.

Article 3 – Account Creation and Eligibility

3.1 Creating an account

Creating a Pixxle Account is free of charge.

During registration, Pixxle may request certain information required to create, manage and secure the account, including:

  • first name;
  • last name;
  • date of birth;
  • email address;
  • telephone number.

Certain additional information may be optional.

The User agrees to provide accurate and up-to-date information.

3.2 Telephone number

The User’s telephone number may be used, in particular, to verify the Pixxle Account, secure access to it, enable certain recovery or verification procedures and help prevent fraudulent or abusive accounts.

The telephone number associated with a Pixxle Account is not made public by Pixxle solely as a result of creating the account.

3.3 Date of birth

The User’s date of birth is used, in particular, to verify compliance with age requirements applicable to the Pixxle Account or certain services and, where necessary, to adapt access to certain features.

It is not made public solely as a result of creating a Pixxle Account.

3.4 Minimum age

Unless otherwise specified for a particular service, Users must be at least 16 years old to create a Pixxle Account.

Pixxle may implement mechanisms intended to verify or enforce this requirement.

3.5 Changing certain information

Certain information may be changed directly through Pixxle Me.

For security and account protection purposes, certain sensitive or identity-related information may require an additional verification procedure.

Where a change cannot be made directly, the User may contact Pixxle at:

Pixxle may request information reasonably necessary to verify the legitimacy of the request.

Article 4 – Authentication and Security

The Pixxle Account uses authentication mechanisms provided by Pixxle and Pixxle Me.

These mechanisms may include a trusted device, verification code, confirmation through Pixxle Me, biometric authentication provided by the User’s device, a QR code or any other security technology offered by Pixxle.

Pixxle may use its IPM – Pixxle Me Identifier – technology as part of its authentication mechanisms.

Authentication methods may evolve to improve security, ease of use or service compatibility.

The User is responsible for the security of the devices used to access their Pixxle Account and must take reasonable precautions to prevent unauthorised access.

If the User suspects fraudulent use or unauthorised access to their account, they must notify Pixxle as soon as possible.

Pixxle may temporarily restrict or suspend access to an account where activity that could compromise its security is detected.

Article 5 – Using the Pixxle Account with Pixxle Applications

The Pixxle Account enables the User to sign in to compatible Pixxle applications and services.

A Pixxle application may access information strictly necessary for its operation and for providing the service requested by the User, in accordance with the information provided to the User and applicable law.

Certain Pixxle applications may collect or process additional data required for their specific features.

Such processing may be subject to additional information or terms specific to the relevant service.

Removing an application from the User’s device does not necessarily result in deletion of the Pixxle Account or data retained by the relevant service.

Article 6 – Connections to Third-Party Services

Pixxle may allow Users to use their Pixxle Account to authenticate with compatible third-party websites, applications or services.

Where a third-party service requests access to certain information associated with the Pixxle Account, the User is informed of the information concerned before authorising the connection where applicable.

Only the data necessary and authorised in connection with that authentication is transmitted to the third-party service.

Using a Pixxle Account with a third-party service does not mean that the third party automatically receives access to all information associated with the Pixxle Account.

The User remains free to refuse a requested permission, subject to certain information being necessary for the operation of the relevant third-party service.

Third-party services remain responsible for their own services and for any data processing they perform after receiving the information, in accordance with their own policies and legal obligations.

Pixxle cannot be held responsible for the operation, content or practices of an independent third-party service.

Article 7 – Personal Data

7.1 General principles

Pixxle places particular importance on the protection of personal data and undertakes to process Users’ data in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR), the French Data Protection Act and other applicable legislation.

Pixxle applies the principle of data minimisation and seeks to collect only the information necessary for the purposes pursued.

7.2 Purposes

Personal data associated with the Pixxle Account may be processed in particular to:

  • create and manage the Pixxle Account;
  • authenticate the User;
  • secure the account and connections;
  • verify certain information;
  • prevent fraud, abuse and fraudulent accounts;
  • provide access to Pixxle applications and services;
  • enable connections to compatible third-party services when requested by the User;
  • provide assistance and support;
  • comply with Pixxle’s applicable legal obligations;
  • improve the security, reliability and operation of the services.

7.3 Legal bases

Depending on the nature of the processing, Pixxle may process personal data on the basis of:

  • performance of these Terms or steps taken at the User’s request;
  • compliance with a legal obligation;
  • Pixxle’s legitimate interests, particularly where necessary to ensure the security of its services, prevent abuse or improve their reliability, subject to Users’ rights and freedoms;
  • the User’s consent where consent is the appropriate legal basis.

Where processing is based on consent, consent may be withdrawn in accordance with applicable law without affecting the lawfulness of processing carried out before its withdrawal.

7.4 Commercial use of data

Pixxle does not sell its Users’ personal data.

Pixxle does not use personal data associated with the Pixxle Account to create advertising profiles intended to be sold to advertisers.

Any use of personal data for commercial communications is carried out in accordance with applicable law and the choices made by the User.

7.5 Hosting and security

Pixxle implements appropriate technical and organisational measures to protect personal data against destruction, loss, alteration, disclosure or unauthorised access.

Pixxle gives preference to infrastructure and service providers located in France or the European Union.

Where data must be transferred outside the European Economic Area, Pixxle implements the safeguards required by applicable law.

7.6 Service providers

Pixxle may use technical service providers acting on its behalf, particularly for hosting, security, technical communications or the operation of certain infrastructure.

Such providers may access data only to the extent necessary to perform their duties and are subject to applicable contractual and legal obligations.

7.7 Data retention

Data associated with a Pixxle Account is retained for as long as necessary to provide the services and manage the account.

Certain data may be retained after account deletion where necessary to comply with a legal obligation, ensure service security, prevent fraud, establish, exercise or defend legal claims or fulfil any other legally permitted purpose.

Applicable retention periods may be further specified in Pixxle’s Privacy Policy.

Article 8 – User Rights

In accordance with applicable law, Users may have the following rights:

  • right of access;
  • right to rectification;
  • right to erasure;
  • right to restriction of processing;
  • right to object;
  • right to data portability where applicable;
  • right to withdraw consent where processing is based on consent.

The exercise of certain rights may be subject to conditions and exceptions provided by applicable law.

Users may exercise their rights directly through features provided within Pixxle Me where available or contact Pixxle at:

Pixxle may carry out reasonable identity verification where necessary to prevent a third party from fraudulently obtaining or modifying personal data.

Users also have the right to lodge a complaint with the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL).

Article 9 – Deleting a Pixxle Account

Users may request deletion of their Pixxle Account through the features available in Pixxle Me where provided or by contacting Pixxle at:

verify@pixxle.me

For security purposes, Pixxle may require verification before processing the deletion.

Deleting a Pixxle Account may result in loss of access to applications and services that use the account.

It may also result in the permanent deletion of certain data or content associated with Pixxle services.

Where account deletion results in the deletion of significant personal content, including files, photographs, videos, memories or other data stored in a Pixxle application, the User may be informed of the consequences before final confirmation of the deletion where applicable.

Users are encouraged to save or export any content they wish to retain before deleting their account where such functionality is available.

Certain information may be retained after deletion within the limits permitted by law and in accordance with Article 7.

Article 10 – Account Suspension or Termination

Pixxle may suspend, restrict or terminate a Pixxle Account in particular in cases of:

  • fraudulent use;
  • attempts to compromise the security of the services;
  • abusive or clearly improper use;
  • serious or repeated breaches of these Terms;
  • legal or regulatory requirements.

Where circumstances permit, Pixxle may inform the User of the action taken and the reasons for it.

Article 11 – Service Availability and Changes

Pixxle endeavours to ensure the availability and proper operation of the Pixxle Account and Pixxle Me.

However, Pixxle does not guarantee uninterrupted or permanent availability.

Interruptions may occur, in particular, for maintenance, updates, security operations or circumstances beyond Pixxle’s reasonable control.

Pixxle may add, modify or remove certain features in order to improve its services, ensure their security, address technical or regulatory requirements or develop its offering.

Where a material change significantly affects the use of a service, Pixxle will endeavour to inform affected Users within a reasonable timeframe.

Article 12 – Intellectual Property

The trademarks, names, logos, interfaces, software, technologies, texts, graphics and other content provided by Pixxle are protected by applicable intellectual property rights.

Unless expressly authorised, nothing in these Terms grants the User ownership rights over these elements.

The User is granted only a personal, limited, non-exclusive and revocable right to use the services for their intended purpose and in accordance with these Terms.

Article 13 – Liability

Pixxle implements reasonable measures to ensure the security, availability and proper operation of its services.

However, Pixxle cannot guarantee that no malfunction, interruption or vulnerability will ever occur.

Pixxle shall not be liable for damage resulting from use contrary to these Terms, negligence by the User regarding the security of their devices, or circumstances beyond Pixxle’s reasonable control.

The limitations contained in this Article do not apply where Pixxle’s liability cannot legally be limited or excluded.

Article 14 – Personal Data Breaches

In the event of a personal data breach, Pixxle will take appropriate measures to limit its consequences and remedy the situation.

Where required by applicable law, Pixxle will notify the competent supervisory authority and inform affected Users in accordance with the conditions and time limits provided by the GDPR.

Article 15 – Paid Services and Subscriptions

Creating and using a Pixxle Account and accessing the essential functions of Pixxle Me are free of charge unless otherwise clearly communicated to the User.

Certain applications or services accessible through a Pixxle Account may offer purchases, subscriptions or paid features.

Such offers may be subject to additional commercial terms presented to the User before purchase.

Article 16 – Applicable Law

These Terms are governed by French law, without prejudice to any mandatory provisions applicable in the consumer’s country of residence.

The French version of these Terms constitutes the reference version.

In the event of a dispute, the parties are encouraged to first seek an amicable resolution.

If no amicable resolution can be reached, the competent courts shall be determined in accordance with applicable law.

Article 17 – Consumer Mediation

Where the User acts as a consumer and applicable law provides for it, the User may have access to a consumer mediator free of charge after first submitting a written complaint to Pixxle and where the dispute has not been resolved satisfactorily.

The mediator’s contact details and procedures will be made available to Users in accordance with applicable legal requirements.
